Your Duty of Care Under the Residential Tenancies Act
Under the Residential Tenancies Act 2010, landlords must provide a property that's fit for habitation and keep it in reasonable repair — an obligation that extends squarely to the electrical installation. Alongside this general duty sit specific, hard statutory requirements for smoke alarms that can't be delegated to the tenant.

What’s Included in a Rental Inspection
- Switchboard condition and safety assessment
- Verification of RCD protection on all required circuits
- Smoke alarm compliance testing per NSW regulations
- Power point and light fitting inspection
- Hot water system electrical condition
- Identification of vintage or non-compliant wiring
- Earthing and bonding verification
- Detailed written report with photos and recommendations
Smoke Alarm Obligations You Can’t Skip
Landlords must check smoke alarms at least once every 12 months to confirm they're working, replace removable batteries annually, and replace the alarm itself within 10 years of its manufacture date. If an alarm is found not to be working, it must be repaired or replaced within two business days of the landlord becoming aware — a tight window that makes a scheduled inspection far cheaper than reacting to a tenant complaint.

Safety Switches: An Urgent Repair Category
NSW doesn't mandate a blanket safety switch retrofit for every existing rental, but if an RCD is found to be faulty, or is detecting an electrical fault at any point during a tenancy, it's treated as an urgent repair. Verifying safety switches are present, correctly rated and working is one of the highest-value checks in a rental inspection.
